Terms & Conditions (Local Prepaid Card)
This annex includes the terms and conditions that govern your relationship with Garpa, regarding the use of prepaid cards offered by Garpa (hereinafter, the "Prepaid Card"). Except in cases expressly established herein, these terms and conditions are an integral part of the Virtual Account Terms and Conditions, which are fully applicable to the use of Prepaid Cards. Any person who does not accept these terms and conditions, which are mandatory and binding, must refrain from requesting and using the Prepaid Card.
Capitalized words not defined in these terms and conditions shall have the meaning provided in the Virtual Account Terms and Conditions.
1. PREPAID CARD
1.1. The Prepaid Card is a registered and rechargeable instrument that can be used to purchase goods, services and/or withdraw funds in the Argentine Republic at establishments affiliated with the MasterCard network. It may also be used to purchase goods and/or services abroad at establishments affiliated with the MasterCard network. In no case may withdrawals be made outside the Argentine Republic. The Prepaid Card may be used for in-person payments, online, by phone or through any other enabled channel.
1.2. The Prepaid Card is not a credit, debit or purchase card, and does not allow installment purchases. Payments or fund withdrawals made with the Prepaid Card will be debited from the available fund balance in the User's Virtual Account.
2. FEES
2.1. The fees applicable to obtaining and using the Prepaid Card are available for consultation at all times in the Application (hereinafter, the "Fees"). Fund withdrawals from ATMs may be subject to additional fees applied directly by the companies responsible for the ATMs, without Garpa's intervention.
3. PREPAID CARD APPLICATION
3.1. When applying for the Prepaid Card, you must provide accurately, truthfully and completely the data and documents required of you (full name, home address, phone number, etc.). You must also keep such data or documentation updated.
3.2. All information or documentation provided to Garpa has the status of a sworn declaration. However, Garpa may request additional supporting documents or information to complete or corroborate the information you have provided, including based on exceeding certain monthly transaction amounts you carry out.
3.3. The Prepaid Card application shall be completed upon your receipt of the Prepaid Card. However, Garpa may reject your Prepaid Card application, suspend or cancel it in the event of detecting inconsistencies in the data or documentation provided, or in the event that you do not provide the additional data or documentation requested. Likewise, Garpa may in any case reject a Prepaid Card application at its sole discretion, without the need to provide you with a justification.
4. ACTIVATION AND USE OF THE PREPAID CARD
4.1. Once you receive the Prepaid Card, you may activate it through the Application and/or any other means that Garpa may make available, following the instructions provided. If the correspondence containing the Prepaid Card is damaged or tampered with, you must reject its receipt and immediately report the incident to Garpa through the available service channels.
4.2. After being activated, the Prepaid Card may be used within the validity period printed on its front and/or as informed in the Application, subject to the available balance in the Virtual Account or in accordance with section 4.5 below and within the daily usage limits for operations determined by Garpa and/or by the associated service networks and within the daily usage limits for operations determined by Garpa and/or by the associated service networks.
4.3. The Prepaid Card is personal and non-transferable. You are solely responsible for the custody and confidentiality of the Prepaid Card and its password. Therefore, you are responsible for all transactions made with the Prepaid Card.
4.4. For security reasons, incorrect entry of the Prepaid Card password at an ATM may result in the retention of the Prepaid Card by the ATM service network. In that case, you must request a new Prepaid Card through the enabled channels.
4.5. The use of the Prepaid Card shall be subject to the availability of the MasterCard network, a circumstance beyond Garpa's control. Transaction approval shall be carried out in accordance with the specific procedures according to the type of transaction or payment channel used. Compliance with the requirements necessary to carry out the transaction implies your acceptance of the transaction and the resulting liability.
4.6. The use of the Prepaid Card is subject to the balance of available funds in your Virtual Account. Transactions made with the Card will reduce the available balance in your Virtual Account in full and in a single debit. In no case may transactions be made with the Cards for an amount exceeding the available balance at any given time. The available balance at any given time may be checked through the Application.
4.7. Any cancellation of a purchase transaction must be requested from the establishment. At the time of the cancellation request, you must obtain the corresponding cancellation receipt directly from the establishment. The Prepaid Card balances shall be refunded to you upon MasterCard's approval of the cancellation.
4.8. In the event of a chargeback request in connection with payments made by card, the analysis and resolution of the claim may take up to 120 (one hundred and twenty) calendar days from the commencement of the chargeback process.
5. PREPAID CARD VALIDITY PERIOD
5.1. The Prepaid Card shall be valid from the date of its activation until the expiration date shown on its front and/or as provided in the Application. Upon expiration of the validity period, the Prepaid Card shall be automatically canceled. Notwithstanding the foregoing, Garpa may cancel the Prepaid Card in the event that you do not use it for a period of 6 (six) months or longer.
5.2. In the event of expiration and/or cancellation of the Prepaid Card, you may request a new Prepaid Card through the enabled channels, the issuance of which shall be at Garpa's sole discretion.
6. REPORTING OF LOSS, THEFT, LARCENY, CANCELLATION AND REISSUANCE OF PREPAID CARD
6.1. You must immediately notify Garpa through the Application or any other enabled means of the loss, larceny, theft or unauthorized use of the Prepaid Card. The Prepaid Card reported as lost, stolen, robbed or improperly used shall be canceled and may not be reactivated.
6.2. You shall be solely responsible for the use of your Prepaid Card until you report the event and obtain confirmation of the cancellation of the Prepaid Card from Garpa. Garpa and MasterCard shall not be liable in any case for the use of the Prepaid Card prior to its effective cancellation.
6.3. Once canceled, the issuance of a new Prepaid Card shall be subject to applicable Fees.
7. CANCELLATION OR SUSPENSION OF THE PREPAID CARD
7.1. You may request the voluntary cancellation of your Prepaid Card at any time through the channels enabled by Garpa.
7.2. In addition, the Prepaid Card shall be canceled or suspended, without limitation, in the following cases: (i) if you report damage, loss, theft or larceny of the Prepaid Card; (ii) judicial or competent authority requirement; (iii) suspicion of fraud, illegal or prohibited use at the sole discretion of Garpa or MasterCard; (iv) suspension or cancellation of your Virtual Account; (v) failure to provide Garpa with requested information or documentation; and (vi) breach of these terms and conditions, including the Terms and Conditions of use of the Application.
8. SERVICE CHANNELS
8.1. Garpa offers various service channels so that you may resolve your questions or make inquiries related to the Prepaid Card. You may obtain help in the Application or by email at help.ar@garpa.money.
9. INTERNATIONAL TRANSACTIONS
9.1. If applicable, the exchange rate to be taken into consideration for the conversion of foreign currency to pesos for transactions made with the Prepaid Card abroad shall be the retail selling exchange rate of Banco de la Nacion Argentina published at the close of the day prior to the date of the transaction ("BNA Exchange Rate") together with any applicable taxes according to the legislation in force at the time of the transaction.
10. LIMITATION OF LIABILITY
10.1. Garpa does not guarantee uninterrupted access to the Prepaid Card usage channels, which may be unavailable due to technical issues, internet failures, MasterCard network unavailability, unavailability of withdrawal terminals or ATMs affiliated with the network, or any other reason, including those beyond Garpa's control.
10.2. You release Garpa and its affiliates from all types of liability for direct damages, lost profits or any other damage or harm you may have suffered in connection with Prepaid Card transactions made, rejected or restricted.
